Petitioner apprehends arrest in a case registered for the offence punishable under Sections 120(B), 387, 506 and other allied sections of Indian Penal Code.
As per prosecution case, all the accused persons including this petitioner abducted and extorted Rs. 2,60,000/- from the complainant.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that specific allegation is against coaccused Gautam Kumar and Santosh Kumar who took money from the complainant on the pretext of providing Government
Patna High Court CR. MISC. No.30876 of 2022(3) dt.10-11-2022 2/2 job to the complainant. No specific overt has been alleged against the petitioner and he has been accused merely because he is nephew of co-accused Gautam Kumar. Complaint has been filed after delay of 18 days. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Motihari, East Champaran in Complain Case No. 1250(c) of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
