Petitioners seek bail in Warsaliganj P.S. Case No. 103 of 2020 registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per F.I.R., petitioners no. 2, 3 and 4 are alleged to have assaulted on the head of informant and when cousin of the informant came to save informant, he was also assaulted, as a result of which, both got injured. Some of the injuries have been found to be grievous in nature.
Patna High Court CR. MISC. No.29060 of 2020(3) dt.05-01-2021 2/2 So far as petitioner no. 1 is concerned, there is no specific allegation of assault.
Considering the aforesaid facts and circumstances, the bail application of petitioners no. 2, 3 and 4 stands rejected. So far as petitioner no. 1 namely Mukesh Kumar @ Mukesh Kumar Yadav @ Mukesh Yadav is concerned, since there is no specific allegation of assault against him, he is enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Nawada in connection with Warsaliganj P.S. Case No. 103 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Singh, J.) anay/- U T
