The petitioners apprehend their arrest in Kishanganj P.S. Case No.485 of 2017 registered under Section 7 of the E.C. Act.
The Block Supply Officer intercepted a vehicle bearing registration No.BR11-2708 which are loaded with 60 bags each containing 50 kg rice. The driver of the vehicle was apprehended. Driver Chandan Kumar Choudhary disclosed that the owner of the rice is Munna Sah, petitioner No.1 and he was going to hand over the rice to Ashok Jain. Petitioner No.2, Tarkeshwar Sah is the owner of the vehicle.
The learned counsel for the petitioners submits that
Patna High Court Cr.Misc. No.63657 of 2017 (2) dt.11-01-2018 there is no control order of rice. It has nowhere stated in the F.I.R. that the bag belongs to S.F.C. or there was any mark of S.F.C. on the bag.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No.485 of 2017(G.R. No.1498 of 2017), subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Saurabh/- U T
