The petitioners apprehend their arrest in Complaint case No. 34 of 2014 under Section 326, 379 and other Sections of the Indian Penal Code.
The complainant alleged that he had ploughed his land by the tractor of Bidur Singh and on demand he paid money to his driver, Nandlal Mukhiya. Bidur Singh called the complainant and demanded money. The complainant disclosed all the facts about the payment of money. The petitioners and Bidur Singh assaulted the complainant.
The learned counsel for the petitioners submits that the occurrence took place on 17.08.2014 but the complaint petition
Patna High Court Cr.Misc. No.76 of 2018 (2) dt.15-01-2018 2/2 was filed on 14.10.2014. This fact itself shows the falsity of the case that the complaint is filed after two months of the occurrence and no explanation is given. There is no injury report on record. Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Abhimanu Kumar, learned Judicial Magistrate, 1st class, Udakishunganj, Madhepura in connection with Complaint case No.34 of 2014, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
