The petitioner seeks bail in a case registered under Sections 420, 379, 406 of the Indian Penal Code. Allegation against the petitioner is that he cheated the company and misappropriated the amount of Rs.10,02,120/-. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.12.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. It is further submitted that the petitioner is ready to deposit an amount of Rs.50,000/- in the court below on the date of furnishing bail bond and further amount of
Patna High Court CR. MISC. No.27253 of 2019(3) dt.14-05-2019 2/2 Rs.2,50,000/- in the court below within a period of six months, which will be subject to the final disposal of the case. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, petitioner is directed to deposit an amount of Rs.50,000/- in the court below on the date of furnishing bail bond and further amount of Rs.2,50,000/- in the court below within a period of six months, which will be subject to the final disposal of the case. Let the petitioner, above named, be released on provisional bail for a period of six months on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Civil Lines P.S. case No.290 of 2018. If the petitioner deposits the aforesaid amount in the court below within the said period, the provisional bail granted to the petitioner will be confirmed by the court below itself. If the petitioner fails to do so, the court below will be at liberty to cancel the provisional bail granted to the petitioner. Narendra/- (Sudhir Singh, J) U T
