JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 307 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, petitioner caused fire arms injury on the left hand below the elbow of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case because of previous enmity. Doctor has found the injuries to be superficial in nature and on non-vital part. Petitioner is in custody since 31.3.2021.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.40492 of 2021(3) dt.22-11-2021 2/2 prayer for bail. He submits that there is specific allegation that petitioner caused fire arms injury on the left hand of the informant.

Considering the aforesaid facts and circumstances of the case, period of custody and the nature of injury, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in Mufassil Police Station Case No. 622 of 2020.
