JUSTICE ASHUTOSH KUMAR ORAL ORDER 01-02-2018 The petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 1138(C) of 2017 instituted for the offences under Section 138 of the Negotiable Instruments Act, 1881 and Sections 406, 420 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that petitioner is ready to contest the case before the Court below and without there being any outstanding debt, he is alleged to have issued cheques to the complainant which got bounced. It has further been submitted that those cheques were deposited with the complainant as security cheques.

No.4293 of 2018 (2) dt.01-02-2018 2/2 named is directed to be released on bail, in the event of his surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, subject to his furnishing bail bond in the sum of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VI, Patna in connection with Complaint Case No. 1138 (C) of 2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
