====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER -------------- 21-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Gopalganj Town P.S. Case No.297 of 2017/G.R. No.2541 of 2017 registered under Sections 414/34 of the Indian Penal Code. The accusation is that in course of patrolling duty by the police, three persons were seen on a motorcycle. When the signal was given to stop the motorcycle, while two persons succeeded to flee away but one person was apprehended, who disclosed his name as Dhananjay Kumar Singh. Dhananjay Kumar Singh also disclosed the name of the two persons, who succeeded to flee away, as Rakesh Kumar Singh (petitioner) and Niraj Singh, saying that he used to commit the theft of the motorcycle alongwith them.

No.62554 of 2017 (2) dt.21-12-2017 2/2 Learned counsel for the petitioner submits that the petitioner has not been apprehended on the spot rather his name has come in the confessional statement of Dhananjay Kumar Singh. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, in connection with Gopalganj Town P.S. Case No.297 of 2017/G.R. No.2541 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
