1. The present writ petition has been filed seeking the following relief(s):- "1. That this writ application is being filed for a direction upon the respondents to remove the encroachment over the land of Bihar Government, Common PWD Road situated at village-Barahi, P.S.-Parihar near Gobarhiya pul bearing Thana No. 129, Khata No. 1092, Khesra No.1346, which

Patna High Court CWJC No.7445 of 2024(2) dt.15-07-2024 2/2 has been illegally encroached by the private respondent Hakim Raine son of Rasul Raine, village-Barahi, P.S.-Parihar, District-Sitamarhi (R-11), by constructing his hut."

2. At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the District Magistrate, Sitamarhi, for redressal of his aforesaid grievances. Liberty so sought is granted.

3. It is needless to state that in case appropriate representation is filed by the petitioner, before the District Magistrate, Sitamarhi, within a period of two weeks from today, the District Magistrate, Sitamarhi, shall ensure that the final order, passed by the Circle Officer, Parihar, DistrictSitamarhi, in connection with Encroachment Case No.04 of 2022 is enforced, forthwith, in case there is no other legal impediment.

4. The writ petition stands disposed off on the aforesaid terms.
