JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2018 The petitioner is apprehending his arrest in connection with Udwant Nagar P.S. Case No. 43/2018, registered for offences punishable under Sections 341, 323, 324, 307, 504 and 506 of the Indian Penal Code and r/w Section 27 of the Arms Act. Allegation against the petitioner is of firing causing injury to the informant.

It has been submitted on behalf of the petitioner is that the petitioner has falsely been implicated in this case and there is no injury report on the record.

Heard learned A.P.P. also who opposed the bail application by stating that there is direct allegation against the petitioner.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.43883 of 2018 (2) dt.26-07-2018 2/2 circumstances of the case, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the Court below and pray for regular bail which would be considered on the nature of injury caused to the informant and the Court below shall pass appropriate order, if possible, on the same day.
