2. The petitioner is in custody in connection with Mansi P.S. Case No. 289 of 2024 for the offence punishable under Sections 126(2), 115(2), 109, 303(2), 352 and 3(5) of the B.N.S. lodged on 04.12.2024 by the informant, Amarjeet Yadav.

3. As per the prosecution story, the informant alleged that after verbal abuse, the accused assaulted the informant's side. Allegation against this petitioner is of giving an iron rod blow on the head of the informant. The further allegation against Nutan Devi is of taking away the gold ornament. Accordingly, the FIR.

4. Learned counsel for the petitioner submits that they are agnates, admitted land dispute is there and scuffle took place between both the parties and their FIR was not lodged.

5. Learned APP opposes the prayer for bail submitting that the allegation against this petitioner is of hitting on the head and the injury has been found to be grievous in nature.

6. Considering the submission of the parties as also the injury report which found the same to be grievous in nature, in that background, for the present, this Court is not inclined to extend him the privilege of bail.
