The petitioner apprehends his arrest in Saraiya P.S. Case No. 264 of 2016 registered under Sections 175, 188 and 406 of the Indian Penal Code.

The Block Education Officer, Saraiya, Muzaffarpur alleged that the petitioner being Panchayat Secretary of Gram Panchayat Raj, RamKrishana Dubiyahi, Muzaffarpur did not hand over the registers, merit lists of the teachers appointed from the year 2003-2010.

Learned counsel for the petitioner submits that on the basis of the allegations made in the F.I.R., the petitioner was granted anticipatory bail vide order dated 21.09.2017 by this

Patna High Court Cr.Misc. No.55178 of 2017 (2) dt.13-12-2017 2/2 Court passed in Criminal Miscellaneous No. 43729 of 2017, but the name of the father of the petitioner and his address have wrongly been written in the bail petition. The petitioner, again, filed fresh anticipatory bail petition.

Considering the facts, aforesaid, the petitioner, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Saraiya P.S. Case No. 264 of 2016 to the satisfaction of the learned A.C.J.M, 1st, West Muzaffarpur or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
