The petitioner is in custody in connection with Kotwa P.S. Case No. 13 of 2019 for the offences under Sections 25 (1b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that one country made pistol with live cartridge was recovered from the possession of co-accused Rakesh Kumar and only mobile phone was recovered from the possession of this petitioner. Learned counsel further submits that petitioner is in custody since 20.01.2019.

Considering the fact that the petitioner has remained in custody for more than three months, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is

Patna High Court CR. MISC. No.28846 of 2019(2) dt.01-05-2019 2/2 directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.
