The petitioner apprehends his arrest in connection with Karja P.S. Case No. 199 of 2018 registered under Sections 363 and 364 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence and he has been falsely implicated in this case and the entire allegation against the petitioner is false and concocted and his name has been given on the basis of confessional statement of co-accused.
Perused the case record, alleged offence against the petitioner under Sections 363, 364 and 302 of the I.P.C. Petitioner is alleged to have kidnapped Jai Prakash Narayan, the
Patna High Court CR. MISC. No.28376 of 2019(3) dt.17-07-2019 2/2 son of the informant under conspiracy and murdered him for ransom with the help of the companion. The co-accused Pankaj Kumar has specifically admitted in her statement under Section 164 Cr.P.C. that he sold the SIM to Azhar and other co-accused has been granted regular bail by this Court.
In the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is hereby rejected. However, the court below is directed to consider the case on merit and dispose of on the same day. (Anjani Kumar Sharan, J) Nasimul/- U T
