1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code read with Section 7 of the Essential Commodities Act.
3. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that 12 quintals of arwa rice was seized from a shop in the village Navinagar on information that it was the government rice which the petitioner blackmarketed and has kept in the aforesaid shop.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is

No.30777 of 2023(2) dt.31-07-2023 2/2 next submitted that the petitioner is not a PDS dealer and even the alleged recovery is from a shop which does not belong to the petitioner and it appears that the informant in order to save the real culprits falsely implicated the petitioner.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Ariyari P.S. Case No. 64 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
