Mr. Umeshanand Pandit,APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-05-2024 Heard learned counsel for the petitioners and Mr. Umeshanand Pandit, learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 324, 307, 379, 504, 506/34 of the Indian Penal Code.
3. As per the prosecution case, on the alleged date and time of occurrence, while the informant was at his house, in the meantime, these petitioners, named in the F.I.R., came there and started abusing him and on protest, the petitioners assaulted him by fists and slaps. It is further alleged that petitioner nos. 1 & 2 assaulted Anita Devi and Savita Devi (both daughters of informant) by means of Dab and when, Lalita Devi (third daughter of informant) came to rescue, she was assaulted by
Patna High Court CR. MISC. No.32830 of 2024(2) dt.22-05-2024 2/2 petitioner no. 3 by means of iron rod.
4. It is submitted on behalf of petitioners that admittedly, there is admitted land dispute between the parties. Both parties are agnates and due to grazing of goats of petitioners in the field of informant, a simple occurrence of Maarpeet took place. Injuries, allegedly caused by petitioners, are simple in nature. Petitioners are ladies and have got clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 336 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
