The petitioner seeks bail in anticipation of his arrest in connection with Muffasil Motihari P.S. Case No. 323 of 2019 dated 18.07.2019 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

From the prosecution report it appears that 198 litres of liquor was recovered from a vehicle which is said to belong to the petitioner.

Learned counsel for the petitioner submits that he was neither occupying the car nor was driving the same. The driver of the vehicle was carrying the aforesaid consignment of liquor without his consent or knowledge.

No.25671 of 2020(2) dt.13-10-2020 2/2 Regard being had to the fact that there was no recovery from the petitioner and his being a person of clean antecedent, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge-cum-Special Judge Excise, East Champaran at Motihari in connection with Muffasil Motihari P.S. Case No. 323 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
