JUSTICE SANJAY PRIYA ORAL ORDER 08-05-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Shikarpur P.S. Case No. 386/2018, instituted for offence under Section(s) 302, 120(B) and 201 of the Indian Penal Code.

It is alleged in the written report that on 07.10.2018 son of informant had gone to see his field. At that time one unknown person called him on mobile phone to come near Peepal Tree. At 10 P.M. the informant made search. On 11.10.2018 informant reached near Peepal Tree, where she felt smell and found dead body of her son lying in Sugar Cane field. Informant raised suspicion against this petitioner and other accused persons due to old dispute.

Learned counsel for the informant has opposed the prayer for bail of petitioner.

Petitioner is in custody since 06.02.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Shikarpur P.S. Case No. 386/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
