JUSTICE SATYAVRAT VERMA ORAL ORDER 11-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Madhepura P. S. Case No.931 of 2020, instituted for the offences under Section 379 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 19.01.2021 and charge-sheet has been submitted in the case.

The learned counsel for the petitioner submits that the informant alleges that he went to the house of Sanjay Kumar on his motorcycle to discuss about Satsang and when he came out of the house of Sanjay Kumar, he found that his Splendor Pro motorcycle as detailed in the F.I.R. was missing. Accordingly, he searched, but was not able to find the motorcycle. Accordingly, it is alleged that motorcycle was stolen by unknown thief.

No.40066 of 2021(2) dt.11-01-2022 2/2 The learned counsel for the petitioner submits that the petitioner has been arrested in this case based on his own confessional statement, but nothing has been recovered from his possession and he has no concern with the seized motorcycle. The learned A.P.P. for the State opposes the bail application and submits that petitioner has criminal antecedents as mentioned in Para-3 of the bail petition.

Considering the fact that the petitioner is in custody since 19.01.2021 and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura in connection with Madhepura P. S. Case No.931 of 2020, subject to condition that one of the bailers shall be the father of the petitioner.

The application stands allowed.
