The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, over a fight relating to a cricket match, it is stated that the accused persons assaulted the brother of the informant leading to his death. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The specific allegation of firing is on co-accused Abhay Kumar @ Baua and that of assault with a dagger is on co-accused Manish

Patna High Court CR. MISC. No.39858 of 2021(2) dt.20-01-2022 2/2 Pandey. The said Manish Pandey has been enlarged on bail vide order dated 25.2.2021 (Annexure-3) and the case of the petitioner stands on a better footing. The petitioner is in custody since 9.10.2020 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case, grant of bail to the co-accused whose orders have been brought on record as Annexure-3 series to the petition and the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.89 of 2021 (arising out of Bihar P.S. Case no.129 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge III, Nalanda.
