JUSTICE ALOK KUMAR SINHA ORAL ORDER 23-06-2026 Heard learned counsel for the petitioner and learned counsel appearing for Dr. Rajendra Prasad Central Agricultural University, Pusa Samastipur.

2. The petitioner in the present writ application have prayed for the grant of following reliefs:

"For issuance of an appropriate writ/ writs, order/ orders, direction/ directions to commanding the respondents university who was working on contractual basissince 12.11.2001 to 10.08.2023 till illegal retirement in the then Rajendra Agricultural University, Pusa Samastipur as well as succeeding university namely i.e. Dr. Rajendra Prasad Central Agricultural University, Pusa Samastipur in the light of latest pronouncement of the

657/2026 alongwith Civil Appeal No.

658/2026 and Civil Appeal No.

659/2026 reported in 2026 (2) PLJR (SC)/202s9 in which the Hon'ble Apex Court has directed to the respondents to regular is the service of such employee who spent/lost his golden time under the respondents as contractual employee in the meantime the petitioner put off from duty of university service by a order passed by non competent non authorized person who simply working in legal section of the University without assigning any legal sanctioned post vide a no. 72 dated 10.08.2023."

After advancing some argument learned counsel for the petitioner prays for withdrawing the present writ application with liberty to file a detailed representation before the Vice Chancellor, Dr. Rajendra Prasad Central Agricultural University, Pusa, Samastipur in light of the recent judgments of the Supreme Court relating to the issue of regularisation.

4. To the aforesaid submission made by learned counsel for the petitioner, learned counsel appearing for respondent-University does not have any objection.

5. Considering the limited nature of prayer made by learned counsel for the petitioner this writ application is disposed of as withdrawn granting liberty to the petitioner to file

Patna High Court CWJC No.7183 of 2026(2) dt.23-06-2026 3/3 an appropriate representation before the Vice Chancellor of Dr. Rajendra Prasad Central Agricultural University, Pusa, Samastipur within one month from today in light of the recent judgments of the Hon'ble Supreme Court on the issue of regularization. If such a representation is filed within the stipulated time, the Vice Chancellor of Dr. Rajendra Prasad Central Agricultural University, Pusa, Samastipur shall dispose of the same within six months from the date of receipt of the representation, after giving an opportunity of hearing to the petitioner. Needless to emphasize that the final order which shall be passed by the Vice Chancellor of the University should be a reasoned and speaking order.

6. With the aforesaid observation and direction the present writ application stands disposed of as withdrawn with liberty as aforesaid. All pending I.As, if any will be deemed to have been disposed of.
