JUSTICE VIKASH JAIN ORAL ORDER 23-06-2021 Heard learned counsel for the petitioner and learned APP for the State through video conference. Learned counsel for the petitioner undertakes that all defects pointed out by the stamp reporter shall be removed, and compliance with the conditions of the notices of this Court with regard to acceptance of e-filing shall be made, without delay immediately upon resumption of normal physical functioning of the Court, and in any event within one month thereof.
2. The petitioner, who is in custody since 09.01.2019, has renewed his prayer for bail in connection with Hathauri P.S.Case No.241 of 2018 (GR.No.7098 of 2018) having earlier been rejected by order dated 27.11.2019 in Cr. Misc. No. 43264
Patna High Court CR. MISC. No.6320 of 2021(4) dt.23-06-2021 2/3 of 2019 for the offences alleged under Sections 147, 148, 149, 447, 323 and 302 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that in a subsequent development, similarly situated co-accused Sanjay Rai, Mohan Rai and Vijay Rai have all been granted anticipatory/regular bail by this Court and so also some other accused persons have been granted bail.
4. Learned APP as well as learned counsel for the informant appear and have been heard.
5. Be that as it may and considering the period of custody already suffered since 09.01.2019 and that other similarly situated co accused persons have been granted anticipatory/regular bail by this Court, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-10-cum-Additional Chief Judicial Magistrate, Muzaffarpur in connection with Hathauri P.S. Case No.241 of 2018 (GR.No.7098 of 2018), if he is not otherwise required in any other case.
6. Office shall follow-up to ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1
