The petitioner is languishing in custody for the offences punishable under Section 304B/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The petitioner is husband of the victim of dowry death.

Earlier prayer for bail was refused on 30.07.2018 vide Annexure-1.

The informant has already been examined during trial and has stated in his evidence that he lodged the case on misinformation and misconception.

Considering the statement of the informant and fate of

Patna High Court CR. MISC. No.31948 of 2019(3) dt.19-06-2019 2/2 the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.214 of 2018, arising out of Parsa Bazar P.S. Case No.132 of 2017, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
