JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-02-2022 Heard Mr. Anish Chandra, learned counsel for the petitioner and Mr. Chandra Sen Prasad Singh, learned Additional Public Prosecutor for the State through video conferencing.
Petitioner seeks regular bail in connection with Kartaha PS Case No. 75/2020 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504 and 506 of the IPC.
The allegation in a nutshell is that the petitioner along with other accused persons altogether eight in number arrived at the cauliflower field of the informant armed with various weapons. It is further alleged that some of the accused persons assaulted the informant and her family members due to which the informant and other sustained injuries.

No.40379 of 2021(3) dt.04-02-2022 2/3 Learned counsel for the petitioner submits that both the parties are neighbours and there is land dispute between them relating to demarcation of the cauliflower field. He further submits that no overt-act has been alleged against the petitioner and the co-accused persons, against whom there is allegation of assault, have been granted bail by the Co-ordinate Benches of this Court vide Annexure-3 series.
Learned counsel next submits that petitioner is in custody since 18.01.2021 having no criminal antecedent. He further submits that there is a counter case inasmuch as Kartaha PS Case No. 76/2020 has been lodged against the informant and other from the side of the petitioner for an incident which has taken place on the same date and time.
Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that both the parties are neighbours, there is land dispute between them and similarly situated co-accused persons have been granted bail by Co-ordinate Benches of this Court, chargesheet has been submitted in the matter, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, RAMANAND SINGH be released on bail on furnishing bail bond of Rs. 10,000/- (Ten
