The petitioner has preferred this application for grant of regular bail in a case registered under sections 420, 406, 379, 120B and 34 of the Indian Penal Code.

As per the prosecution case, the accused persons including the petitioner herein proceeded to deposit cash in the ATM belonging to the IDBI Bank. In the evening, it transpired that Rs. 20 lakhs was missing.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case only for the reason that he happens to be the guard. There is no allegation to the effect that any occurrence took place. The cashiers namely, Deepak Kumar and Santosh Kumar have been

Patna High Court CR. MISC. No.39959 of 2021(4) dt.21-02-2022 2/2 enlarged on bail vide order dated 17.11.2021 passed in Cr. Misc. No. 39607 of 2021 and order dated 23.11.2021 passed in Cr. Misc. No. 48240 of 2021. The petitioner is in custody since 20.03.2021 and has no criminal antecedent. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for almost a year not having any criminal antecedent and grant of bail to the above named two co-accused, the Court directs the petitioner to be enlarged on bail in connection with Khagaria P.S. Case No. 241 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Khagaria.
