The petitioner is languishing in custody for the offence punishable under 30(a) of the Bihar Prohibition and Excise Act.
Liquor was allegedly recovered from two vehicles. The petitioner was not there at the time of recovery nor the case diary reveals that the petitioner was owner of any of the vehicle from which liquor was recovered. Petitioner has got criminal cases against him including cases under Excise Act. However the petitioner is in custody since 11.02.2020 and there is no direct material against the petitioner at all so far this case is concerned. Investigation of the case is already complete. There is nothing to say that the petitioner is going to tamper with the evidence.

No.29519 of 2020(3) dt.18-01-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Buxar (M) P.S. Case No. 391 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
