Petitioner apprehends arrest in connection with Complaint Case No. 146 C of 2017 registered for the offence punishable under sections 323, 379, 498A, 504/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner is the husband of the complainant and he never demanded any dowry or tortured the complainant. The marriage was solemnized in the year 2007 and they have two children aged about 7 and 5 years, and as such, there is no question of demand of any dowry. The
Patna High Court CR. MISC. No.28022 of 2019(2) dt.29-04-2019 2/2 present complaint has been filed after two years of the alleged occurrence without there being any plausible explanation for the delay. Petitioner is ready to keep his wife with full honour and dignity.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Birpur, Supaul in connection with Complaint Case No. 146 C of 2017 subject to the conditions laid down under section 438(2) Cr.P.C.
