JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-02-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Hasanpur P.S. Case No. 125 of 2017 for the offences punishable under sections 341, 323, 325 and 307/34 of the I.P.C and section 25 (1-B) a of the Arms Act.
In the FIR specific allegation is against co-accused Anil Kumar Sahni who has assaulted with iron rod to the informant causing fracture of his hand and against the petitioner only allegation is that he also came with him. Anil Kumar Sahni was caught by the villagers with pistol.
Patna High Court Cr.Misc. No.63127 of 2017 (2) dt.01-02-2018 2/2 Submission is of false implication and that there is case and counter case, no such occurrence has taken place, the petitioner without any fault has been implicated only with a view to colour the case, no injury has been caused to the informant and as such the petitioner deserves sympathetic consideration. The learned A.P.P. submits that the petitioner was also with Anil Kumar Sahni.
In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M-III, Rosera, District- Samastipur in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
