Let the defect(s), if any, be removed within four weeks after complete start of the physical Court. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Six litres of liquor was recovered from the house of co-accused Mosafir Ram who is father of the petitioner. Petitioner has stated that he is separate from his father. Petitioner has got an identical criminal antecedent and that case also reveals that foreign liquor was recovered from the house of the petitioner.

Considering criminal antecedent of the petitioner, this

Patna High Court CR. MISC. No.39904 of 2021(2) dt.14-12-2021 2/2 is not a fit case for grant of anticipatory bail in connection with Basantpur P.S. Case No. 26 of 2021 pending in the Court of learned 2nd Additional Sessions Judge-cum-Special Judge, Siwan/successor Court.

Hence, prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within a period of two weeks from today, prayer for regular bail shall be considered without being prejudiced by this order. (Birendra Kumar, J) Kundan/- U T
