The petitioner seeks anticipatory bail in connection with Guraru PS case no. 78 of 2015 registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 353, 333, 337, 427, 307, 188, 504, 506, 109, 115 of the Indian Penal Code and 27 of the Arms Act.

The allegation is that when the police was taking the dead body of a person, which was lying near the railway track, the villagers had stopped the police from carrying the dead body and in the process thereof scuffle and brick batting took place resulting in injury to the police personnel.

The learned counsel for the petitioner submits that there is

Patna High Court Cr.Misc. No.2513 of 2018 (2) dt.16-02-2018 2/2 general and omnibus allegation against the accused persons and no specific overt act has been attributed to the petitioner. It is submitted that several other accused persons have been granted bail.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Gurua PS case no. 78 of 2015, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
