The petitioner apprehends his arrest in connection with Dumraon P.S. Case No. 102 of 2023 dated 05.03.2023 registered for the offence under Sections 409, 120(b), 34 of the Indian Penal Code.

The case relates to disappearance of record of Case No. 129 of 1990-1991 from the Consolidation Office, Nawanagar, Buxar and the petitioner is found responsible for the said record.

Taking note of the allegation of disappearance of

No.31381 of 2023(4) dt.16-10-2023 2/2 government record against the petitioner, who was the custodian of the record in question and also the fact that the matter is also adjudicated in the Civil Writ Jurisdiction of this Court vide C.W.J.C. No. 6585 of 2022 and the prosecution of the petitioner in the present case is initiated by the order of the High Court dated 20.02.2023, this Court is not persuaded by the submission advanced by the learned counsel for the petitioner and does not find it a fit case for grant of anticipatory bail to the petitioner. Accordingly, the prayer for grant of anticipatory bail to the petitioner is rejected.
