JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

Prosecution case is that 600ml of illicit liquor was recovered from possession of co-accused, Amod Kumar Singh. Learned counsel appearing for the petitioner submits that recovery has been made from the vehicle and nothing has been recovered from the conscious possession of the petitioner. Petitioner is neither owner nor driver of the said vehicle. The name of the petitioner has transpired during investigation. Petitioner has got no criminal antecedent.

Learned counsel for the State opposed the prayer for

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Addl. District Judge Excise Act, Jhanjharpur, Madhubani in connection with Andhramath Police Station Case No. 113 of 2017 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
