The petitioner apprehends her arrest in connection with Agamkuan P.S. Case No.182 of 2017 registered under Sections 302 and 201/34 of the Indian Penal Code.
The accusation is that the marriage of Lakshminia Devi, the daughter of the informant Pachchu Mahto, was performed in the year 2003 with Anil Mahto, son of Dharmnath Mahto, resident of village-Bari Pahari, Police Station-Agamkuan, District-Patna. After sometime, she was being abused and tortured by her husband. On 19.04.2017, in the evening at about 04.00 P.M., the informant received message that his daughter has been killed by
Patna High Court Cr.Misc. No.55313 of 2017 (2) dt.28-11-2017 2/2 her husband and sister-in-law (Nanad) Arti Devi (petitioner) and her dead body has been disposed of.
Learned counsel for the petitioner submits that the petitioner is the married sister-in-law (Nanad) of the deceased, the daughter of the informant, and has falsely been implicated in this case. Further submission is that it would appear from the F.I.R. that no allegation of torturing the deceased, the daughter of the informant, has been made against the petitioner. The name of the petitioner has only been added in the F.I.R. because she is the sister-in-law (Nanad) of the deceased, the daughter of the informant. The petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Patna City, Patna, in connection with Agamkuan P.S. Case No.182 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
