The petitioner seeks bail in Buxar (Ind.) P.S. Case No. 36 of 2019, instituted for the offence under Section(s) 341, 323, 467, 468, 471, 406, 420, 120(B), 376 and 511/34 of Indian Penal Code.
Counsel for the petitioner submits that petitioner is handicapped person, in support of which, medical certificate has been enclosed as Annexure-2. He further submits that petitioner is Director of Divyang Jan Kalyan Seva Sansthan. There is no documentary evidence to show that informant has paid Rs.4,00,000/- to the petitioner. There is no allegation of assault or attempt to commit rape against the petitioner. The Sansthan
Patna High Court CR. MISC. No.28263 of 2019(2) dt.01-05-2019 2/2 of the petitioner is registered organization. Petitioner is in custody since 7.3.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxaar in connection with Buxar (Ind.) P.S. Case No. 36 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
