JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2018 The petitioner is apprehending his arrest in connection with Warisaliganj P.S. Case No. 163/2018, registered for offences punishable under Sections 147, 149, 323, 353, 427, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner and several other accused persons is that they entered in the office of the Electric Supply Sub-Division, Warisaliganj and abused and threatened the officials.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed against the petitioner and he has falsely been made accused in this case.

Learned counsel for the State opposed the prayer for

Patna High Court Cr.Misc. No.42580 of 2018 (3) dt.24-07-2018 2/2 grant of anticipatory bail on the ground that the petitioner is accused in ten other cases.

Having heard both sides, considering the facts and circumstances of the case and the criminal antecedents of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner rather he should surrender before the court below and make prayer for regular bail and the court below shall consider the same on the merit of the case and shall try to pass an appropriate order, if possible, on same day.
