The petitioner apprehends his arrest in a case registered for the offence under Sections 272/273/34 of the IPC and Sections 30(a)/36/41 of the Bihar Prohibition & Excise Act. 962 liters 200 ml. of foreign liquor has been recovered from two cars, parked near the hut of co-accused Anand Sahni. It is submitted on behalf of petitioner that nothing has been recovered from the possession of this petitioner and has got no concern with the alleged recovery, but he has been made accused in this case only on the basis of confessional statement of co-accused.

However, learned A.P.P. for the State vehemently opposed the prayer for bail and submitted that petitioner has got one criminal antecedent of similar nature.
