In this case, the petitioners are seeking anticipatory bail in connection with Ballia P.S. Case No.84 of 2016, registered for the offence punishable under Sections 447, 379, 506 and 384/34 of the Indian Penal Code.

Allegation has been made that while the informant

Patna High Court Cr.Misc. No.59258 of 2018(2) dt.06-10-2018 2/3 was at Delhi, he was informed that the present petitioners along with 21 other accused persons have harvested the standing wheat crop and they have demanded Rs.10,00,000/- by way of ransom. On this information, the informant came to her native place and lodged the F.I.R.

Learned counsel for the petitioners submits that admittedly the informant came to his native place on 30.03.2018, but the F.I.R. has been filed after a delay of 10 days, inasmuch as, earlier the petitioners have lodged a case against the informant, stating therein that Rs.19,00,000/- was given to the informant by way of consideration money, but when they demanded for registration of the land, they have not done the same. He further submits that the informant had also filed similar case against the petitioners with regard to the said land. It appears that there were litigations between the parties on account of sale and purchase of the land and on that account, this case has been lodged.

Looking to the aforesaid facts, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties

Patna High Court Cr.Misc. No.59258 of 2018(2) dt.06-10-2018 3/3 of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case no.84 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
