Apprehending his arrest in complaint case no. 374 of 2017 registered under Sections 323, 406 and 504/34 of the IPC and Section 138 of the N.I. Act, the petitioner has approached this Court for grant of anticipatory bail.
After placing the complaint learned counsel submits that the allegation of giving cash amount by the complainant is to co accused Krishna Prasad Keshri who instead of returning the amount in cash issued two cheques which got dishonored. Petitioner is only the family member. The allegation is that complainant when went to demand money he abused and fisted.
Patna High Court Cr.Misc. No.2771 of 2018(2) dt.15-01-2018 2/2 It is also pointed out that today this Court in Cr. Misc. no. 2599 of 2018 has granted the privilege of anticipatory bail to similarly placed other co-accused persons.
Considering the aforesaid submissions, let the petitioner, named above, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Bhabhua in connection with Complaint case no. 374 of 2017, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that one of the bailors shall be his own/close family member.
