2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 447, 341, 323, 384, 379, 386, 504 and 506/34 of the Indian Penal Code.
3. On the alleged date and time of occurrence, all the F.I.R named accused persons including these petitioners armed
Patna High Court CR. MISC. No.30722 of 2023(2) dt.20-07-2023 2/3 with weapons came to the Petrol Pump of informant and abused him and thereafter they entered in the office of petrol pump and on point of pistol, they snatched bag with cash of Rs. 36,000/- and mobile from the staffs of informant.
4. It is submitted that for the same occurrence two F.I.R was lodged. One case bearing Sugauli P.S case No. 517/21 was lodged by the staff of the informant in which there is no allegation of Rangadari and loot. After twelve days of the alleged occurrence the present F.I.R was lodged by the informant with allegation of Rangadari and loot, which can not be believed. The dispute has been resolved and a compromise petition has been filed by both parties.
5. Learned counsel for the petitioners oppose the bail petition.
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M. Motihari East Champaran at Motihari in connection wit Sugauli P.S. Case No 534 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal
