1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397, 307, 412 and 120B of the Indian Penal Code read with Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that this is the third attempt of the petitioner to seek bail.

4. It is a case of road robbery and firing, the petitioner was apprehended along with Raja at the place of occurrence by the villager and two other accused persons fled, but then while fleeing, firing was made which caused injury to a villager,

Patna High Court CR. MISC. No.28834 of 2025(3) dt.06-08-2025 2/3 Monu, the petitioner along with Raja who were apprehended by the villager disclosed the name of the person who fired as Kundan.

5. Learned counsel for the petitioner submits that petitioner is in custody since 10.02.2023, charges have been framed and trial has commenced. It is also submitted that no doubt petitioner was apprehended from the place of occurrence, but then no incriminating articles were recovered from his possession.

6. Learned A.P.P. for the State opposes the prayer for bail of the petitioner and submits that petitioner has antecedent of two criminal cases of serious nature. It is next submitted that trial has commenced and out of eight prosecution witnesses, three prosecution witnesses have been examined, as would manifest from the report of the learned Trial Court contained in Letter No. 88 dated 22.05.2025. It is thus submitted that trial has commenced and is progressing.

7. Considering the submissions made by the learned APP for the State, the Court is not inclined to release the petitioner on bail, however, directs the District Magistrate, Samastipur and the Superintendent of Police, Samastipur to ensure that all the prosecution witnesses are produced before the

8. Let a copy of this order be sent to the District Magistrate, Samastipur and the Superintendent of Police, Samastipur for their perusal and necessary action.

9. Accordingly, the instant bail application is rejected.
