JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Kasba P.S. Case No. 02 of 2020 for the offences under Section 392 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner would submit that in the present case the petitioner was remanded on 27.05.2020.

It is alleged that on his disclosure, the petitioner has been made accused but the police has not prayed for requisition for remand of the petitioner and only after four months the petitioner was remanded in the present case. In this case there is allegation against the petitioner that he was involved in looting a bag containing Rs.1,18,578/- and Tablet of Samsung Company.

Patna High Court CR. MISC. No.29302 of 2020(2) dt.10-11-2020 2/2 Learned counsel for the petitioner submits that the authenticity of the seizure list was doubted. He submits that the persons whose residence is 20-25 kilometers away have been made seizure list witnesses in this case.

Considering the fact that the petitioner was remanded on 27.05.2020 but he has not been put on test identification parade, the Court is inclined to grant bail to him subject to the condition that the petitioner has to deposit Rs.50,000/- in cash. On depositing the amount of Rs.50,000/-, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Kasba P.S. Case No. 02 of 2020.

Deposit of Rs.50,000/- (Rupees fifty thousand) shall abide by final outcome of the instant criminal case. (Anil Kumar Upadhyay, J) BT/- U T
