2. Petitioner seeks bail who is in custody since 24.09.2025 in connection with Bhawanipur P.S. Case No. 102 of 2025 for the offences punishable under Sections 137(2), 140(1) and 96 of BNS.
3. The case of the prosecution, in brief, is that Rupam Kumari, daughter of Bipin Bihari Pandit gave a written application on 23.05.2025 to the SHO of Bhawanipur Police Station alleging therein inter alia that she is residing at Birbanna Deohari as renter for purpose of reading her children. It has been further alleged that on 18.05.2025 at 06.00 A.M. her

Sohel then mobile was switch off again on 19.05.2025 from the same mobile number call was come and asked her that her daughter Garima Gaurav was in his custody then she remember that since last one year Md. Sohel was teasing her daughter in way of coaching and when she complained to his parent then his parents ask for forgiveness then she has full faith that her daughter Garima Gaurav was kidnapped for human traffic king due to which social tension raised between Hindu and Muslims. It has been further alleged that Md. Sohel with his entire family members with conspiracy kidnapped her daughter and when after going to her daughter when she searched her home then found that her daughter had taken away her jewellery and cash of Rs. 3,75,000/-.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and is innocent and he has falsely been implicated in the present case. It is further submitted that the allegation as alleged in the FIR is forged and fabricated and the petitioner has not committed any offence as alleged in the FIR.
5. The learned Additional Public Prosecutor for the
Patna High Court CR. MISC. No.30720 of 2026(2) dt.06-05-2026 3/3 State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that the victim in her statement recorded under Section 183 of BNSS has fully supported the case of the prosecution. Apart from that the medical report of the victim also suggests that the petitioner has committed wrong with her and the date of birth of victim is 19.06.2012 which suggests that on the date of occurrence the victim was minor.
7. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Bhawanipur P.S. Case No. 102 of 2025 pending in the court of learned District & Additional Sessions Judge III, Naugachia, Bhagalpur.
8. Prayer is refused.
