JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 23-09-2015 Heard Mr. Rupak Kumar in support of the application which seeks restoration of I.A. No. 3691 of 2013 filed in C.W.J.C. No. 7704 of 1996 which stood dismissed for non-prosecution vide order dated 12.8.2015.

With reference to the photo copy of the cause list dated 12.08.2015 which has been enclosed as annexure, it has been submitted that the name of the counsel for the petitioner was not properly printed which prevented him from appearing on call in the said case.

Copy of the application was served on the advocate who represent the petitioner in C.W.J.C. No. 7704 of 1996. Although his name appears in the cause list but no one has appeared to oppose the petition.

Considering the facts and circumstances of the case, the

Patna High Court MJC No.2488 of 2015 (2) dt.23-09-2015 2/2 application is allowed. The order dated 12.8.2015 dismissing I.A. No. 3691 of 2013 is recalled. While listing the case, the office will properly print the name of Mr. Rupak Kumar who appears for respondent nos. 6(c) to 6(g).
