The petitioner apprehends his arrest in a case registered for the offence under Section 272, 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition & Excise Act. 30 liters of country-made liquor has been recovered from the motorcycle of the petitioner.

It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the motorcycle in question. Nothing has been recovered from the possession of this petitioner. However, learned A.P.P. for the State vehemently opposed the prayer for bail and submitted that petitioner has got one criminal antecedent of similar nature.

Considering the criminal antecedent of the petitioner,
