JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Turkauliya P.S. Case No. 686 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379, 448, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. Prosecution story is that petitioners attacked the house of the informant and assaulted the informant and his family members, causing injuries to them and when police case they have also attacked the police party.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties and there is land dispute from before, due to that petitioners have been made accused and no specific allegation has been attributed against any of the petitioners except petitioner No.3 and injuries are simple in nature.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioners.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.36668 of 2019(3) dt.16-08-2019 3/3 petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Turkauliya P.S. Case No. 686 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
