11-12-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends her arrest in Sathi P.S. Case No. 85 of 2019 registered for the offence under Sections 365, 384, 385, 388, 166 and 120(B) of the Indian Penal Code. As per the prosecution case, it is alleged that this petitioner, in collusion with police party of Sathi Police Station, got arrested son of the informant and demanded Rupees Fifty lacs from the informant in lieu of releasing her son. It is submitted hat present case has been lodged by the informant only with a view to put pressure on this petitioner. As a matter of fact, this petitioner was raped by the son of the informant on the pretext of marriage, for which, this petitioner had lodged a case against the son of informant,

Patna High Court CR. MISC. No.29398 of 2020(2) dt.11-12-2020 2/2 vide Sathi P.S. Case No. 162 of 2018, and only with a view to save his son from that case, the informant has lodged this false case. Petitioner is lady and has got clean antecedent, as stated in paragraph - 3 of the petition.

Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of her arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Sathi P.S. Case No. 85 of 2019, subject to condition as laid down under Section 438(2) of the Cr.P.C.
