The petitioner seeks bail in Konch P.S. Case No.156 of 2011(G.R. No.4942/2011) registered under Sections 147, 148, 149, 447, 427, 435 and 379 of the Indian Penal Code, under Section 17 of C.L.A. Act and under Sections 13, 16, 18 and 20 of U.A.P.A. Act.

The informant named five persons and many others unknown and alleged that they came inside the premises of the tower set the battery house ablaze and fled after raising slogan of Maobadi Jindabad.

The learned counsel for the petitioner submits that petitioner is in jail since 07.09.2018. The offence is triable by the Magistrate and many other similarly situated accused

Patna High Court CR. MISC. No.31452 of 2020(2) dt.01-12-2020 2/2 persons namely Jyoti Paswan, Ramsevak Yadav @ Ram Sevak Yadav, Sudhir Paswan and Satyendra Ravidas @ Bidhayak Jee have been granted bail by the orders annexed as Annexure-2 series. The case of the petitioner stands on the same footing and petitioner is in jail for more than two years. Taking into consideration the facts aforesaid and the fact that petitioner is in jail for last more than two years and the trial has not yet been concluded, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Gaya in connection with Konch P.S. Case No.156 of 2011(G.R. No.4942/2011).
