Heard learned counsel for the petitioners and the learned APP for the State.

Petitioners seek regular bail in connection with Kawakole P.S. Case No. 402 of 2022 dated 17.07.2022 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 383, 307, 379 and 34 of Indian Penal Code and Section 27 of the Arms Act.

The main submissions advanced by learned counsel for the petitioners are that the petitioners earlier preferred Cr. Misc. No. 55138 of 2022 for the relief of regular bail which was rejected by this Bench with a liberty given to the petitioners to renew their bail prayer after the framing of charge and accordingly in the light of the said liberty they have again come
Patna High Court CR. MISC. No.30886 of 2023(2) dt.17-05-2023 2/2 before this Court for the relief of bail. Further submissions are that the petitioners have no criminal antecedent and they have been languishing in jail since 17.07.2022 and against them the investigation has been completed and upon them the charges have been framed on 12.04.2023 and in the present time they are facing trial and there is general and omnibus allegation against all the accused persons including the petitioners and injury reports of the so called injured persons do not support the prosecution's version and in between both the parties there is case and counter-case.

Considering the above submissions, in my opinion, in the present circumstances as submitted above, both the petitioners are now entitled to be released on bail. Accordingly, let the petitioners named above be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of concerned Court in connection with Kawakole P.S.
