Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Baheri P.S. Case No. 36 of 2021 for the offence punishable under Sections 304-B/34 of the Indian Penal Code. Learned counsel for the petitioners seeks permission to withdraw this bail application on behalf of petitioner no. 1, above named.

Accordingly, this bail application is dismissed as withdrawn as against petitioner no. 1, above named. However, if the petitioner no.1 surrenders in the

Patna High Court CR. MISC. No.39638 of 2021(2) dt.21-03-2022 2/2 Court below within a period of four weeks from today and seeks regular bail, the Court below shall consider and decide the same in accordance with law without being influenced by the order of this Court.

So far as the bail of petitioner no.2 is concerned, his bail application is allowed in view of the fact that he is the junior member of the family.

Accordingly, let the petitioner no.2, above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, VII, Darbhanga, in connection with Baheri P.S.
