2. The petitioner has preferred this application for grant of regular bail in connection with Manjhagarh P.S. Case No. 349 of 2025 registered for the offences punishable under Sections 103(1)/238/61(2) of B.N.S.

3. As per the prosecution case, on 17.09.2025, at about 7:30 P.M., the brother-in-law of the informant went outside the house and thereafter went missing. It is further alleged that on 20.09.2025, the dead body of the informant's brother-in-law was recovered from a canal. As per allegation the informant did not initially express suspicion against anyone but it has been alleged in the concluding portion of the FIR that

Patna High Court CR. MISC. No.29196 of 2026(3) dt.24-06-2026 2/3 some time earlier there had been a quarrel with co-accused Sahid Ali @ Langda, who had also threatened the deceased.

4. Learned counsel for the petitioner has submitted that the petitioner is not named in the FIR and has falsely been implicated in this case. It has further been submitted that the name of the petitioner has transpired on the basis of the confessional statement of Sahid Ali @ Langra before police while in police custody. It has further been submitted that the said Sahid Ali @ Langda had confessed his guilt and made an inculpatory statement that he has murdered the deceased with the help of co-accused person including this petitioner. Moreover, Sahid Ali @ Langra has already been granted the privilege of bail by a coordinate Bench of this Court vide order dated 26.02.2026 passed in Cr. Misc. No. 5472 of 2026. It has also been submitted that the charge sheet has been submitted in this case and there is no allegation of tempering with the evidence against the petitioner. Lastly, it has been submitted that the petitioner has got no criminal antecedent and he is in custody since 21.09.2025.

5. Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner. It has been further submitted by learned counsel

6. Heard the parties and perused the record.

7. Considering the facts and circumstances of the case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Gopalganj/concerned court below, in connection with Manjhagarh P.S. Case No. 349 of 2025.
